These Terms and Conditions constitute an agreement (the “Agreement”) between you (the “User”/”Client”) and Sneaky Wholefoods (A.B.N. 46 404 683 840) and contain the terms and conditions that apply to your access and use of the Services provided by Us.

Terms of Use

• By engaging us, you signify that you agree with these terms and conditions. If you do not agree, do not use, engage, or access the Service.
• Sneaky Wholefoods reserves the right to modify this Agreement and/or the Policies from time to time. Please check this page regularly for updates.

Service Description

• Sneaky Wholefoods is an online snack store.
• Items sold through the online store will be referred to as “Products”.
• Business hours vary but generally are 8:00am to 3:00pm, Monday to Friday.

 Payments

• Payments will be made in Australian Dollars (AUD).
• Payment methods include Credit Card (via Stripe), PayPal and/or Afterpay.
• Full and punctual payment is required to confirm orders.
• In the event of non-payment, all legal costs and collection agency fees will be paid by the Client.
• Sneaky Wholefoods reserves the right to amend pricing at any time.

Currency Conversion Fees: For international customers, please note that a 2% conversion fee may be applied to your order if your payment is processed in a currency different from the currency of our store. This fee is charged by Shopify to cover currency conversion costs, and it will be added to the total amount at checkout. The conversion fee is in addition to any other charges or fees that may apply based on your location or payment method.

 Deliveries

• Products will be delivered via Australia Post, a courier company.
• Delivery addresses cannot be altered once an Order has been processed, if you need to update your postal address prior to your order being processed email daisyjarvis_sneaky@outlook.com with your Full Name, Order Number and Updated Address.
• Ownership of parcels transfers to the buyer once handed over to the delivery service.
• Sneaky Wholefoods is not responsible for any loss or damage after the parcel has been delivered.
• Orders will be processed within 3 business days of receipt.
• Estimated delivery time-frames range from 3-12 business days.
• Ensure someone is available to receive your order.
• Unattended deliveries may be left in a safe place or returned to a post office or depot.

Cancellations and Refunds

Sneaky Wholefoods reserves the right to cancel transactions with incorrect pricing or descriptions.

• Refunds will be issued for errors in pricing or descriptions, excluding postage and handling costs.
• Damaged products due to our fault will be replaced or refunded.
• Gifted products are non-refundable or changeable.

Product Satisfaction

We are committed to bringing our customers the highest quality handmade snacks. If you are not 100% satisfied with your purchase, you are entitled to a full refund of the product purchase price, applicable to first purchases only, excluding sale items. Requests must be made within 14 days for Australian orders and 28 days for international orders.

 User’s Obligations

• Comply with this Agreement and all applicable laws and regulations.
• Provide accurate information to Sneaky Wholefoods.
• Do not use Sneaky Wholefoods for any illegal or immoral purpose.

 Intellectual Property

• The content of Sneaky Wholefoods Website is protected by intellectual property laws.
• Social media sharing of images must credit and link back to www.sneakywholefoods.com.
• Do not modify, rent, lease, loan, sell, distribute, or create derivative works based on any content unless authorized by Sneaky Wholefoods.

 Liability

• Sneaky Wholefoods accepts no liability for loss or deterioration of goods once delivered.
• Sneaky Wholefoods will not be held liable for any financial or physical damages.
• Products include allergen statements and detailed ingredient listings.
• Sneaky Wholefoods will not be liable for failure to acknowledge ingredient lists.
• Products must be stored according to the included instructions to maintain quality.
• Sneaky Wholefoods is not liable for defamatory or offensive material found in connection with the use of Sneaky Wholefoods.

Disputes and Mediation

• Complaints should be directed to daisyjarvis_sneaky@outlook.com.
• Mediation will be the first cause of action if disputes cannot be resolved through communication.
• The Client will bear all legal/mediation/arbitration fees associated with disputes.

Choice of Law

This Agreement is governed by the laws of Western Australia.

• If any terms are invalid or unenforceable, they may be struck out, and the remaining terms will continue in full force.

Law Enforcement

Sneaky Wholefoods reserves the right to cooperate with law enforcement authorities in any jurisdiction concerning any lawful direction or request.

Sale Terms & Conditions

Prices are as marked during the promotional period. This sale excludes subscriptions, gift cards, and limited-edition protein balls. No further discounts can be applied (Brand Ambassador Codes accepted).

Please note that Club Nourish points cannot be redeemed during the sale period.
